Ley de Protección del Estado del Niño
La Ley de Protección del Estado del Niño (CSPA) fue promulgada con el fin de mantener a las familias inmigrantes unidas a pesar de los tiempos de espera basados en la familia y basados en el empleo que pueden ser hasta 22 años o más.
Antes de CSPA, una vez que el hijo cumplia 21 años de edad, ya no era elegible para emigrar (o ajustar su estatus) junto con su familia. CSPA elimina este problema por medio del “congelamiento de la edad” inmediatemente cuando los padres ciudadanos estadounidenses presentan una solicitud de visa en su nombre, o cuando un padre que es residente permanente se naturaliza, o cuando un hijo casado que ha sido solicitada por un padre ciudadano se divorcia o queda viudo.
CSPA también crea una fórmula matemática que permite que el tiempo que una petición estuvo pendiente sea restada de la edad del niño.
¿Qué ocurre si un hijo pasa de la edad requerida apesar de la fórmula matemática? Una vez más, CSPA proporciona un alivio para los hijos en la forma de una clausula automática de conversión. Sin embargo, este tramo de CSPA está siendo litigado por nuestra firma de abogados ante un tribunal federal de apelaciones.
CSPA es aplicable a la mayoría de personas que habían presentado solicitudes antes del 6 de agosto del 2002 y las personas que fueron patrocinadas para la residencia permanente después que la ley tomo efecto. Por lo tanto, se aplica a cientos de miles de personas.
